Introduction

Welcome to Century Cricket Centres ("CCC", "we", "us", "our"). These Terms of Use ("Terms") govern your use of the Century Cricket Centres mobile application ("App") and access to our indoor cricket training facilities ("Facilities").

The Century Cricket Centres App is powered by StanceBeam technology and provides comprehensive membership management, facility booking, and performance analytics services for cricket training.

1. Definitions

• "Account" means your user account created through the App
• "Facilities" means Century Cricket Centres indoor training facilities
• "Services" means all services provided through the App and Facilities
• "User Content" means any data, information, or content you provide or generate through use of our Services

2. Eligibility and Registration

2.1 Age Requirements

• Primary account holders must be 16 years or older
• Minors (under 16) may use Facilities under family memberships with adult supervision
• All users must be physically capable of participating in cricket training activities

2.2 Account Registration

• Provide accurate, complete, and current registration information
• Maintain the security and confidentiality of your account credentials
• Immediately notify us of any unauthorized use of your account
• One person per account (no shared accounts)

2.3 Account Responsibility

You are solely responsible for:

• All activities conducted through your account
• Maintaining accurate account information
• Safeguarding your member fob and login credentials
• Any charges incurred through your account

3. Membership Plans and Services

3.1 Membership Types

Standard Membership:

• 12-Month: $2,077.92 annually
• Weekly: $49.95

Family Membership

• 12-Month: $2,077.92 + $416 annually
• Weekly: $49.95 + $10 per additional family member

Premium Membership:

• 12-Month: $4,160 annually
• Weekly: $100 charged fortnightly

The above amount is excluding taxes. For the weekly plan membership, Renewal happens biweekly. A one-time, non-refundable registration fee of $50 applies at the time of joining.

3.2 Membership Benefits

• 24/7 access to indoor training facilities
• Unlimited use of professional-grade equipment including:
  • Professional bowling machines
  • Video projection systems

  • Speed sensors and delayed video replay
• Performance analytics and feedback
• Lane booking through the App

3.3 Membership Terms

• 12-Month Memberships: Non-refundable
• Bi-Weekly Memberships: No lock-in contract, cancellable with 14 days' notice from upcoming billing cycle
• Membership Pausing: Available for up to 8 weeks annually at $5/week and 4 weeks annually at $5/week for Biweekly membership
• Rejoining: Former members pay current membership rates upon rejoining
• Waiting List: May apply when facility reaches capacity

4. Facility Access and Usage

4.1 Access Rights

• Access granted 24/7 to active members in good standing
• Entry via App-based digital access
• Access may be temporarily restricted for maintenance or safety reasons

4.2 Lane Booking System

• Book training lanes through the App with real-time availability
• Advance booking recommended during peak hours
• Cancellations must be made according to our cancellation policy
• No-shows may result in booking restrictions

4.3 Equipment Usage Rules

• All equipment is pre-set and ready for immediate use
• Follow all posted safety instructions and equipment guidelines
• Report equipment malfunctions immediately via the App
• Do not attempt to repair, modify, or relocate equipment
• Clean equipment and training area after use

4.4 Training Options

• Solo Training: Individual practice sessions
• Partner Training: Train with another member
• Small Group Sessions: Available for family members or organized groups
• Technology-Enhanced Sessions: Access to StanceBeam analytics and video analysis

5. Payment Terms and Billing

5.1 Payment Processing

• All payment processing handled through secure third-party payment gateways
• Century Cricket Centres does not store complete credit card information
• Payment details are encrypted and transmitted directly to authorized payment providers
• We receive only limited transaction information necessary for membership management
• Automatic recurring billing for applicable membership types

5.2 Payment Obligations

• Membership fees are charged as specified in your chosen membership plan
• Failed payments may result in immediate membership suspension
• Members responsible for updating payment information before expiration
• Late fees may apply for overdue accounts

5.3 Refund Policy

• 12-Month Memberships: Non-refundable
• Weekly Memberships: Refunds processed according to notice period requirements
• Paused Memberships: Unused pause time does not roll over between years

6. StanceBeam Technology and Performance Data

6.1 Data Collection

• StanceBeam sensors collect real-time performance metrics during training
• Data includes bat speed, swing angles, ball tracking, and technique analysis
• Performance data linked to your account for progress tracking
• Video recordings available for technique analysis and coaching review

6.2 Data Ownership and Usage

• You retain ownership of your personal performance data
• We may use aggregated, anonymized data for facility improvement and research
• Personal data will not be shared with third parties without explicit consent
• Data retention policies outlined in our Privacy Policy

6.3 Technology Access

• Access to professional-grade technology typically unavailable to amateur players
• Real-time feedback systems and gamification features
• Performance analytics dashboard through the App
• Session footage archival for coaching analysis

7. Acceptable Use and Conduct

7.1 Facility Conduct

Members must:

• Respect other members and maintain appropriate behavior
• Follow all safety protocols and posted guidelines
• Use equipment only for intended cricket training purposes
• Maintain cleanliness and organization of training areas
• Wear appropriate athletic attire and safety equipment

7.2 Prohibited Activities

The following are strictly prohibited:

• Sharing member account access with non-members
• Bringing non-members into the facility without authorization
• Damaging or misusing equipment or facilities
• Recording or photographing other members without consent
• Using facilities for commercial purposes without written permission
• Consuming alcohol or illegal substances on premises
• Engaging in behavior that disrupts other members' training

7.3 App Usage Guidelines

• Do not attempt to hack, reverse engineer, or exploit the App
• Report technical issues or security vulnerabilities promptly
• Respect intellectual property rights of all App content
• Use App features only for legitimate membership and training purposes

8. Safety and Risk Management

8.1 Assumption of Risk

• Cricket training involves inherent risks of injury
• Members participate voluntarily at their own risk
• Ensure physical fitness appropriate for cricket training activities
• Follow all safety instructions and use protective equipment when required

8.2 Safety Obligations

Members must:

• Report injuries or accidents immediately to management
• Use safety equipment provided (helmets, pads, etc.)
• Follow posted safety guidelines and equipment instructions
• Inform staff of any medical conditions that may affect training

8.3 Emergency Procedures

• Emergency contact information must be provided during registration
• Emergency procedures posted throughout the facility
• First aid equipment available on premises
• Members responsible for having appropriate medical insurance

9. Limitation of Liability and Indemnification

9.1 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• CCC's liability is limited to the amount of membership fees paid
• CCC is not liable for indirect, incidental, or consequential damages
• CCC is not responsible for injuries resulting from misuse of equipment
• CCC maintains appropriate insurance but members assume primary responsibility for their safety

9.2 Indemnification

You agree to indemnify and hold harmless CCC, its employees, and affiliates from any claims, damages, or losses arising from:

• Your use of the facilities or equipment
• Your violation of these Terms
• Your negligent or wrongful conduct
• Any injury to third parties caused by your actions

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms an integral part of these Terms. By using our Services, you consent to our data practices as described in the Privacy Policy.

Key privacy commitments:

• Secure handling of personal and performance data
• Limited data collection for service provision
• No sale of personal information to third parties
• Right to access, correct, or delete personal data

11. Intellectual Property Rights

11.1 Ownership

• The App, technology systems, training programs, and facility designs are owned by CCC or licensed to CCC
• All content, trademarks, and intellectual property remain property of respective owners
• StanceBeam technology subject to separate licensing agreements

11.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the App solely for accessing our Services. You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer or attempt to extract source code
• Use our intellectual property for commercial purposes
• Remove or alter proprietary notices or labels

12. Termination

12.1 Termination by Member

• Weekly memberships: 14 days' written notice required
• 12-month memberships: No early termination except during cooling-off period
• Account closure available through App or by contacting member services

12.2 Termination by CCC

We may immediately terminate membership for:

• Violation of these Terms or facility rules
• Non-payment of membership fees
• Dangerous or inappropriate conduct
• Fraudulent activity or misrepresentation
• Capacity management or business reasons (with appropriate notice)

12.3 Effect of Termination

Upon termination:

• Immediate loss of facility access and App services
• No refund of prepaid, non-refundable membership fees
• Performance data may be retained according to our Privacy Policy
• Outstanding charges remain due and payable

13. Modifications to Terms and Services

13.1 Terms Updates

• CCC reserves the right to modify these Terms at any time
• Material changes will be communicated via App notification or email
• Continued use after notification constitutes acceptance of modified Terms
• Current Terms always available through the App

13.2 Service Changes

• We may modify, suspend, or discontinue Services with reasonable notice
• Equipment upgrades and facility improvements may occur periodically
• New features and technology may be added to enhance member experience
• Pricing changes apply to new memberships and renewals

14. Dispute Resolution

14.1 Initial Resolution

• Good faith efforts to resolve disputes through direct communication with management
• Member services available via App or phone during business hours
• Formal complaint process available for unresolved issues

14.2 Binding Arbitration

• Disputes not resolved through direct negotiation subject to binding arbitration
• Arbitration conducted according to local arbitration rules
• Each party bears their own costs unless otherwise determined by arbitrator
• Class action waivers apply where legally permitted

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CCC regarding use of our Services.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.

15.3 No Waiver

CCC's failure to enforce any provision does not constitute a waiver of future enforcement of that provision or any other provision.

15.4 Assignment

You may not assign these Terms or your membership without written consent. CCC may assign these Terms in connection with business transfers.

15.5 Force Majeure

CCC is not liable for delays or failures in performance due to circumstances beyond our reasonable control.

16. Governing Law and Jurisdiction
